Acceptance of terms

By downloading, accessing, or using ForkYa!, users agree to these Terms of Service and the ForkYa! Privacy Policy. If a user does not agree, they should not use the app or website.

License to use the app

ForkYa! grants users a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes, subject to these terms and any applicable App Store rules.

Use of the app

ForkYa! is provided to help users track food, review nutrition estimates, understand eating patterns, organize uploaded lab results, and receive AI-assisted coaching. Users are responsible for how they use the information.

No medical advice

ForkYa! does not provide medical advice, diagnosis, or treatment. Nutrition estimates, bloodwork context, health scores, coaching responses, and related outputs are informational only. Users should consult qualified professionals for medical, health, diet, supplement, medication, or treatment decisions.

Nutrition and AI estimates

Photo-based, voice-assisted, barcode, nutrition label, bloodwork extraction, and AI-assisted outputs can be incomplete, inaccurate, or based on imperfect input. Users should review and correct estimates when precision matters.

User content

Users are responsible for content they provide, including photos, descriptions, logs, corrections, bloodwork files, and messages. Users should only submit content they have the right to use and should avoid submitting unnecessary sensitive information.

Subscriptions, trials, and billing

ForkYa! may require Premium access to use the main app experience after onboarding. Eligible users may be offered a trial before paid billing begins. Subscription billing, renewal, cancellation, and refund handling are managed through the App Store or relevant payment provider. Subscriptions may automatically renew unless canceled according to the provider's rules.

Acceptable use

Users agree not to misuse ForkYa!, interfere with the service, attempt unauthorized access, reverse engineer the app or services, bypass limits or paywalls, upload unlawful or infringing content, or use the app in a way that violates applicable law.

Availability and changes

ForkYa! may change, suspend, or discontinue features, plans, pricing, or availability at any time. ForkYa! may update these terms over time, and continued use after changes means the updated terms apply.

Termination

ForkYa! may suspend or terminate access if a user violates these terms, misuses the service, creates risk, or if continued access is no longer commercially or legally practical.

Disclaimer of warranties

ForkYa! is provided as-is and as-available, without warranties of any kind to the maximum extent allowed by law. ForkYa! does not warrant that the app will be uninterrupted, error-free, or that nutrition, bloodwork, or coaching outputs will be complete or accurate.

Limitation of liability

To the extent allowed by law, ForkYa! and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, health outcomes, or business opportunities arising from use of the app.

Indemnification

Users agree to defend and hold ForkYa! harmless from claims, losses, liabilities, damages, costs, and expenses arising from misuse of the app, user content, violation of these terms, or violation of law or third-party rights.

Governing law

These terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules, unless applicable law requires otherwise.
